The responsibilities and duties of a parent, as well as the legal authority, powers and rights to make decisions in respect of a child is known as parental rights and responsibilities (PR & R). These rights are not automatically given in all cases, and those who have PR & R over a child, have the right to make decisions regarding child’s lifestyle and welfare, such as schooling, religion, where the child should live and even what they should eat. Although natural mothers have automatic parental rights and responsibilities, a father will only have such rights if he is registered as the father at birth, or if he is married to the mother.
In adoption cases, couples can apply for parental responsibility to the court by way of an adoption order, which has the effect of extinguishing the parental responsibility of those holding PR & R previous to this. In surrogacy cases, couples may apply for PR & R through the court by way of a parental order.
