A Minute of Agreement (or separation agreement) is a procedure by which two or more parties can decide on the details of their separation without going to court. In Scotland, it must be registered in the Books of Council and Session for it to be enforceable. It can be used by cohabiting couples who are separating, or married couples who wish to separate but who don’t want to divorce.
A Minute of Agreement can cover all aspects of a partnership, such as childcare arrangements, bill payments, savings, debt, child maintenance payments, who should reside in the family home and who pays the mortgage. Our solicitors will be able to ask any questions you may have surrounding a Minute of Agreement. Give us a call today to arrange an appointment.
